I am a 14-year-old video creator and seeing we can be fined up to $42,000 dollars for a single video if the FTC thinks its mislabeled scares me. So, anyway here is my question.

Can I get fined and punishments put on my channel for making videos for all audiences but marking it not directed at kids? Am I allowed to make videos that are appropriate for kids but don't necessarily want it to be recommended to kids? 

Another big concern for me is, will they fine young creators like me?

Why are creators being punished for something youtube could have enforced way before this.

If I make Minecraft lets plays and mark it as not directed at kids could I get in trouble if a kid watches my videos?

I am really worried about this and I have bad anxiety so I cant stop worrying at all.


I need some answers.

I am also in this gray-area. On one hand, someone from the FTC from the outside will most likely see Minecraft as a children’s game and that’s what scares me. It’s the general knowledge, or lack there of, that scares me. If a FTC sees a Minecraft video, sadly I have a feeling they won’t give it a second thought and mark it as incorrect.

As for me, I am not willing to let the FTC fine me 42k for 1,000 subscribers. Although it stinks, right now I am planning on marking my entire channel as made for kids near January 1st. It stinks having poured hundreds of hours into your channel only to have all the comments and likes removed/altered but at the same time, I have to be thinking about the long term.  The risk of being fined 42k scares me and I am not willing to risk it all.

I am holding off on changing my channel until a week before the change takes place because there are some meetings planned with content creators and the FTC to talk about the COPPA.
I am, at the same time, hopeful and thinking not much is going to come from this meeting.

This is the government so there is practically no way you can fight anything they throw at you.  If any content creators are planning on hoping that they don’t get fined and if they do, they’ll just fight it, well all I have to say is get ready for the fight of your life.

If in doubt, select no. Easy. The fines will only be levied against people that select yes with content that is NOT meant for children.

By the law of averages SOMEONE's video is going to be maybe for kids or maybe not.

Am I correct in guessing that if I set a video to "not for kids" and it is possibly deemed "for kids" that I'll get a notification or an admin will just change it for me? Or will I immediately get a fine for $42,000?

I'm totally cool with having my "not for kids" choice changed by the folks at YouTube if they or the FTC deem it "for kids" even though my opinion may not agree.

So, if I'm understanding the COPPA law correctly, you're only in potential trouble if you publish content that the FTC considers to be targeted toward kids, AND you have marked it as NOT being directed toward children.
All other scenarios seem to be out of the scope of the COPPA law.

By the way, you can still receive compensation for your kid-directed content, but it will be significantly less than before this law goes into effect. (E.g., if you watch the kids content, using YouTube Premium, then YouTube gives a cut to the content provider.)
